Thank you for bringing to my attention the problems with the language contained in the proposed rules for HMO regulation recently published by the Department of Insurance and Securities Regulation. I share your concerns about section 3513.3 of the proposed rules and have written to the Acting Director of the Department, Larry Mirel, to seek a change in that section so that it conforms with Title I of the District Code.

Dear Mr. Mirel:

I wanted to bring to your attention the enclosed letter from the Gay and Lesbian Activists Alliance regarding the language of the proposed rulemaking on the regulations for Health Maintenance Organizations which were recently published in the June 25, 1999 edition of the D.C. Register.

I share GLAA's concerns about the omission of sexual orientation from the Equal Employment Opportunity statement contained in subsection 3513.3 of the proposed rules. As you may be aware, the DC Human Rights Act of 1977, exceeds federal EEO protections by including sexual orientation, among other additional categories. I would highly recommend that your legal counsel consult Title I, Chapter 25 for guidance on this matter, specifically §1-2501, before finalizing the language of the proposed rules, and change subsection 3513.3 to accurately conform to District law.
